RESIDENTIAL TERMS AND CONDITIONS
1. Who We Are
Awaken Cleaning Services provides high-quality, reliable residential cleaning services across the Wollongong and Illawarra region. We care about your home and aim to deliver service that feels personal, respectful, and consistent.
2. What These Terms Cover
These Terms apply to any residential cleaning services we provide to you. When you book a service or accept a quote, you agree to these Terms.
3. Definitions
• Company means Awaken Cleaning Services, its employees, contractors, and permitted assigns.
• Client means the individual engaging the Company for cleaning services as specified in the Quote or Agreement.
• Services means residential cleaning services provided by the Company as outlined in the Quote or Proposal. • Quote/Proposal means a written description of the Services and pricing provided to the Client, including any agreed service frequency and scope.
4. Your Booking
• We’ll provide a quote outlining the services, schedule, and cost.
• Quotes are valid for 30 days and can be accepted via email, message, or confirmation of booking.
• Services will begin once the quote is accepted, and any required upfront payment is made.
5. Payment Terms
• For one-off cleans or specialty cleans such as end of lease etc., full payment is required before your clean.
•For regular cleans, payment is due before or within 24 hours after each clean (depending on your quote).
• Payments can be made via bank transfer, card, or another agreed method.
• If payment isn’t made on time, we may pause future bookings until resolved.
6. Cancellations and Rescheduling
• Please give at least 24 hours’ notice if you need to cancel or reschedule.
• If you cancel with less notice or we can’t access your home, the full service fee may still apply.
• You can cancel by email, text, or phone.
7. Access and Safety
• Please ensure we can safely enter and work in your home at the agreed time.
• Let us know about pets, alarms, or anything else we should be aware of.
• If we can’t access your property, the fee for your scheduled clean will still apply.
8. Equipment and Supplies
• Unless agreed otherwise, we will provide all necessary cleaning products and equipment.
• If you ask us to use your products or tools, we aren’t liable for any issues or damage that may result. Awaken your home.
9. Non-Solicitation
• The Client agrees that during the term of this Agreement and for a period of 12 months following its termination, the Client will not directly or indirectly solicit, employ, or engage any employee or contractor of the Company who was involved in providing the Services, without the Company’s prior written consent.
10. Insurance and Indemnity
• We carry public liability insurance for your peace of mind.
• You agree not to hold us responsible for loss or damage unless it’s caused by our negligence.
11. Confidentiality and Privacy
• We respect your privacy and will keep any personal or household information confidential.
• We collect your details only for booking and service purposes, and we never share your data without consent.
12. Subcontractors
• Sometimes we may send a trusted team member or subcontractor to assist. Rest assured, they meet our standards and are covered by the appropriate insurance.
13. Service Adjustments
• If you need to make changes to your booking, please let us know in writing by email or text.
• We’ll confirm if we can accommodate the change and let you know if pricing is affected.
14. Limitation of Liability
• Nothing in these Terms limits your rights under the Australian Consumer Law.
• If something goes wrong, we’ll either fix the issue or refund the relevant amount.
• We are not responsible for indirect losses, delays beyond our control, or issues caused by client-provided equipment.
15. Termination of Services
• You can cancel ongoing services any time with 7 days’ notice.
• We may occasionally need to change service days or team members and will give notice when possible.
16. Photos and Videos
• By accepting our cleaning services, you agree that the Company may take before and after photos of the areas cleaned at your property. These photos are for the purpose of documenting the service provided. We will ensure that no sensitive or personal information is included in these images. These photos may be used for marketing, promotional, and quality assurance purposes, with your consent. If you prefer that photos not be taken, please notify us in advance.
17. Force Majeure
• The Company is not liable for any failure or delay in providing Services due to events beyond its reasonable control, such as natural disasters (e.g. fire, flood, earthquake), pandemics or government imposed restrictions, strikes, lockouts or labour disputes, unavailability of supplies or equipment, illness or injury affecting key personnel, or any other event outside the Company’s control that materially affects its ability to deliver Services. 18. Variations
• Minor changes may be made to these Terms and Conditions and agreed in writing via a Quote/Agreement or, in certain circumstances, by email at the discretion of the Company.
• Any request by the Client to vary the scope or nature of the Services must be made in writing. The Company may accept or reject such requests at its sole discretion. Any agreed variation must be confirmed in writing by the Company and may result in an adjustment to the fees.
19. Assignment
• You can’t transfer your booking or agreement to someone else without our written consent.
20. Waiver
• If we don’t enforce a term right away, it doesn’t mean we can’t do so later.
21. Severability
If any part of these Terms is found to be invalid, the rest will still apply.
22. Entire Agreement
These Terms, together with any accepted quote, are the whole agreement between you and us.
23. Feedback and Dispute Resolution
• If you have a concern or a complaint about our service, please let us know as soon as possible. We’ll do our best to work with you to sort things out quickly and fairly.
• If we can’t resolve the issue together, either of us can suggest using a free or low-cost mediation service, such as those provided by NSW Fair Trading, a community justice centre, or the Australian Commercial Disputes Centre (ACDC).
• If a dispute arises, both parties agree to attempt to resolve it in good faith before taking legal action.
• Each party must continue performing its obligations during the dispute resolution process.
• This clause does not limit your rights to seek assistance from consumer protection agencies or to take the dispute to a tribunal or court.
24. Governing Law
These Terms are governed by the laws of New South Wales. 25. Client Acknowledgement By accepting this Proposal or booking a service, the Client acknowledges they have read and agreed to these Terms and Conditions.
